Navigating Legal Needs Alongside Survivors

For many, the justice system feels steady and available whenever needed. There is an expectation that justice WILL be served. It may be a system that operates at a distance, but it’s bedrock. However, for many survivors, “The systems that were supposed to protect victims during trafficking — including the criminal justice and legal systems — failed. Survivors broke free from trafficking through what amounted to sheer force of will.” (Polaris)
We’ve experienced this time and time again with clients. Navigating the criminal justice and legal system can be overwhelming. Daunting amounts of paperwork. Substantial legal fees. Systemic injustices make trust-based engagement unlikely. And for survivors of exploitation, seeking justice through the legal system can also bring with it many challenges that can lead to retraumatization.
We believe survivors should not have to navigate this complex system alone. Our team at Red Oak Hope steps in to provide side-by-side support for clients, advocating for and collaborating with the survivor seeking justice. We often coordinate with multiple individuals within the justice system to gather around a single client, effectively leading a legal care team to provide support for a case. We also provide education for clients on the nuances of the criminal justice system, which can be opaque and confusing, so they can be informed, exercise agency, and avoid retraumatization through what can be a long and painful process. The pro bono support from trusted providers offers critical legal insight, advice, and sometimes direct representation of clients.

It is important to note that there are many barriers clients must overcome before they ever engage with the legal system, or even have the desire to do so. Whether they’ve had previous experiences with the system failing to protect them from their abuser, generational discrimination toward marginalized populations, or interactions with law enforcement that reinforced harmful power dynamics, survivors may shy away from seeking help within the criminal justice system.

Navigating any complex system, especially the legal system, can also be a significant barrier for those living with disabilities. We are particularly mindful of the support clients may need in this regard. This underscores the importance of having someone sit alongside clients, walk through each piece of paperwork, and translate legal jargon into clear, accessible information to help them understand what matters most.
